Terms of Service

Plain-language summary: Play fairly, be truthful about who you are, respect other people, and do not misuse the service or its branding. Honest opinions and lawful comparisons are welcome. The complete terms below control if a summary and the full text differ.
1. Agreement and eligibility
These Terms are a binding agreement between you and the operator of the Five & Three service (“Five & Three,” “we,” “us,” or “our”). They apply to the website, game, accounts, communications, tournaments, and related services. By creating an account or using an authenticated account, you agree to these Terms and the policies expressly incorporated into them.
During the Limited Beta, you must have reached the age of majority where you live and must also accept the Limited Beta Agreement. If you use the service for an organization, you confirm that you have authority to bind it.
2. Independent identity
Five & Three is the official name and identity of this service. Unless we clearly state otherwise, the service is independent and is not sponsored by, endorsed by, operated by, or affiliated with another game, publisher, platform, or brand.
You may not impersonate Five & Three or its staff, create a confusingly similar account or presentation, falsely claim an affiliation, or knowingly misrepresent the source, ownership, status, or features of the service.
3. Accounts and security
Provide accurate account information, keep credentials and verification codes private, and notify Support if you believe an account has been compromised. You are responsible for activity performed through your account except activity caused by our own security failure. Screen names and profiles must not impersonate another person or organization, violate another person’s rights, or evade a restriction.
4. Fair play and acceptable use
You may not:
- harass, threaten, stalk, discriminate against, or exploit another person;
- cheat, collude across opposing teams, manipulate rankings, use unauthorized automation, or interfere with a game or tournament;
- probe, scrape, reverse engineer, overload, bypass security, or access non-public systems except with written permission or through an authorized security test;
- upload malware, unlawful material, or content that infringes another person’s privacy, publicity, copyright, trademark, or other rights;
- use the in-service chat, profiles, tables, or messages to advertise, recruit for, or solicit customers for another service without written permission;
- evade a suspension, create abusive duplicate accounts, or help someone else violate these Terms.
5. Opinions, comparisons, and factual claims
You may express honest opinions, criticize the service, and make lawful comparisons. Nothing in these Terms requires a positive review or prevents a truthful report about your experience.
You may not knowingly or recklessly publish a materially false statement of fact about Five & Three, its staff, its users, or its relationship with another organization. This rule does not turn disagreement, opinion, parody, or a good-faith mistake into a violation. Nothing here restricts a lawful report to a regulator, law-enforcement agency, court, legal adviser, or other protected disclosure.
6. Content, feedback, and intellectual property
You keep ownership of content you submit. You give us a non-exclusive, worldwide, royalty-free licence to host, reproduce, transmit, moderate, and display that content only as reasonably needed to operate, secure, improve, and promote the service, subject to the Privacy Notice. You may delete content where the product provides that control, subject to legal, safety, backup, and recordkeeping needs.
If you voluntarily submit an idea or suggestion, we may use it without payment or an obligation to implement it. The Five & Three name, logo, original artwork, interface, software, audio, written materials, and other original service assets belong to us or our licensors. These Terms do not claim ownership over general card-game ideas, facts, or material that the law does not protect.
7. Moderation and enforcement
We may remove content, restrict features, suspend, or terminate an account when reasonably necessary to protect users, enforce these Terms, comply with law, prevent fraud, or secure the service. Serious or urgent harm may require immediate action. Where practical, we will provide a reason and a way to ask Support for review. We may preserve relevant records for safety, dispute, and legal purposes.
8. Service changes and availability
We may add, change, pause, or discontinue features. We do not promise uninterrupted availability or that every error will be corrected. Special beta risks are described in the Limited Beta Agreement. Paid plans, if offered later, will have the price, renewal, cancellation, and refund information shown at purchase.
9. Disclaimers and responsibility
To the maximum extent permitted by applicable law, the service is provided “as is” and “as available,” without implied promises beyond those the law does not allow us to exclude. We are not responsible for indirect, incidental, special, or consequential loss that was not reasonably foreseeable. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded, including responsibility for fraud, wilful misconduct, or other liability that law makes non-waivable.
10. Changes, governing rules, and disputes
We may update these Terms for legal, safety, or product reasons. We will identify the version and date, and will ask you to accept material changes before continuing where appropriate. The laws applicable where the service operator is established govern these Terms, without taking away mandatory rights you have where you live. Courts with lawful jurisdiction may hear disputes. These Terms do not require confidential arbitration or waive a right that applicable law says cannot be waived.
