Limited Beta Agreement

The balanced version: You can say what you honestly think. What you cannot do is leak non-public test material, publish knowingly false factual claims, impersonate the service, compromise security, harass people, or use our platform to promote another service.

1. Purpose and term

The Limited Beta gives a small group early, free access so we can test gameplay, capacity, safety, and usability. It begins when you accept this Agreement and continues until we end your access or announce that the information is public. Beta access is temporary and does not promise lifetime access, a paid benefit, a particular launch date, or continued availability.

2. Unfinished software and resets

The beta may contain bugs, incomplete or experimental features, outages, scoring errors, tournament interruptions, and security or compatibility issues. Games, scores, rankings, messages, achievements, accounts, or other data may change or be reset. Do not rely on the beta to preserve irreplaceable information. No payment is required for Limited Beta access.

3. What is confidential

“Confidential Beta Information” means non-public material you receive or observe through the Limited Beta, including:

  • private invitation links, access codes, and non-public tester communications;
  • unreleased features, roadmaps, experiments, administration tools, and internal plans;
  • screenshots or recordings of non-public beta screens and sessions;
  • non-public bugs, vulnerabilities, exploits, technical details, and security controls;
  • another tester’s non-public personal information.

It does not include information that becomes public through no breach by you, that you already lawfully knew without a duty of confidence, that you independently developed without using Confidential Beta Information, or that you lawfully received from someone permitted to disclose it.

4. What you agree not to share

Without written permission, do not publicly post, stream, forward, sell, or otherwise disclose Confidential Beta Information. In particular, do not share private invitation links, non-public screenshots or recordings, unreleased features, tester communications, or non-public bug and security details. Take reasonable care to keep this material private.

For ordinary non-trade-secret information, this confidentiality obligation ends when we make that information public or 12 months after your beta access ends, whichever comes first. Information that legally remains a trade secret stays protected only while it qualifies for that protection.

5. Honest reviews and protected reports

You do not have to praise the service. You may express honest opinions, provide candid feedback, make lawful comparisons, and describe your general experience as long as you do not reveal Confidential Beta Information or knowingly or recklessly make materially false factual claims.

Nothing in this Agreement prevents you from reporting suspected unlawful conduct to a regulator or law-enforcement agency, complying with a court order, obtaining confidential legal advice, or making another disclosure protected by law. If legally permitted, please give us reasonable notice before a compelled disclosure so we can seek appropriate protection.

6. Security reporting

Report a suspected vulnerability privately through Support and do not access, alter, or retain another person’s data. Do not publicly disclose exploit details while they could reasonably put users or the service at risk. We will acknowledge a good-faith report and work toward a reasonable remediation timeline. This clause does not prevent a protected report to an authority or lawful disclosure after the issue is resolved or after a reasonable coordinated-disclosure period.

7. Conduct inside the beta

The Terms of Service apply. During the beta, you must not impersonate or misrepresent Five & Three, falsely claim an affiliation with another brand, harass another user, cheat or manipulate results, run unauthorized load or automated testing, evade a restriction, or advertise, recruit for, or solicit customers for another service within Five & Three without written permission.

8. Feedback

Please use Report a Bug for defects and the Suggestion Box for ideas. You grant us a perpetual, worldwide, non-exclusive, royalty-free right to use, adapt, and incorporate voluntary feedback without payment or an obligation to implement it. This licence covers the idea or feedback, not unrelated personal content.

9. Enforcement and ending access

We may pause or end beta access when reasonably necessary to protect people, confidential information, fair play, or security, or to enforce this Agreement. Serious or urgent risks may require immediate action. Where practical, we will explain the reason and provide a Support review path. Sections that by their nature should continue—including confidentiality for the limited period above, intellectual property, records, and lawful remedies—survive the end of access.

10. Complete beta agreement

This Agreement supplements the Terms of Service and Privacy Notice. If it conflicts with the Terms only about beta testing, this Agreement controls. It does not remove mandatory rights or protections that applicable law gives you. We will ask you to accept a new version if a material change requires renewed consent.
